1. Agreement to these terms

These Terms & Conditions ("Terms") govern your access to https://synnow.com and the related websites, patient-facing technology, content, support, transactions, and services that link to these Terms (collectively, the "Services"). The Services are operated by SYN Health, Inc., doing business as SYN Now. By accessing or using the Services, creating an account, or indicating acceptance electronically, you agree to these Terms and our Privacy Policy.

If you do not agree, do not use the Services.

2. The parties have separate roles

SYN Now provides non-clinical technology, information, marketing, customer support, and administrative services that facilitate access to telehealth. SYN Now does not make clinical decisions, practice medicine, prescribe medication, or dispense medication.

Healthcare is provided by the independent medical group responsible for your care and its licensed clinicians (collectively, "Providers"). Providers exercise independent professional judgment and are responsible for diagnosis, treatment decisions, prescriptions, and clinical follow-up. Prescriptions are filled and dispensed by independently owned and licensed pharmacies ("Pharmacies"). Providers and Pharmacies may give you additional terms, privacy notices, consents, and instructions.

3. Eligibility and availability

You must be at least 18 years old, be legally capable of entering an agreement, and be physically located in a jurisdiction where an assigned Provider is authorized to treat you at the time of care. Services, treatments, and pharmacy fulfillment are not available in all jurisdictions and may change based on licensure, law, clinical appropriateness, and pharmacy capability. We may verify your identity, age, and location.

4. Telehealth and no guarantee of treatment

Telehealth may use questionnaires, photographs, records, secure messaging, telephone, audio, or video. You must review and accept the Telehealth Consent before receiving care. Completing an intake or paying a consultation fee does not guarantee that a Provider will diagnose a condition, issue a prescription, or determine that a requested treatment is appropriate. A Provider may require more information, a video or telephone encounter, testing, in-person care, or referral to another clinician.

5. Medical information and emergencies

Website content is general information and is not medical advice, diagnosis, or a substitute for an individualized evaluation. A provider-patient relationship is established only as permitted by applicable law and only with the Provider involved in your care. Do not ignore professional medical advice because of information on the Website.

The Services do not provide primary, urgent, or emergency care. If you experience a serious reaction, chest pain, trouble breathing, fainting, sudden vision or hearing changes, an erection lasting more than four hours, thoughts of self-harm, or another emergency, call 911 or seek immediate in-person care.

6. Prescriptions and compounded medication

Prescription products require a valid prescription based on a Provider's independent assessment. A Provider may prescribe an FDA-approved medication, a compounded medication, or no medication. Compounded medications are prepared for an individual patient by a licensed pharmacy pursuant to a prescription. They are not FDA-approved, and FDA does not review their safety, effectiveness, or quality before they are marketed. A compounded product is not an FDA-approved generic equivalent.

Use medication only as prescribed and follow the pharmacy label and provider instructions. Do not share medication. You are responsible for disclosing complete medical history, allergies, pregnancy status, medications, supplements, and changes in your health. Review our Important Safety Information and contact your Provider with clinical questions.

7. Fees, cash-pay services, and recurring orders

Prices and included services are shown before purchase. Unless expressly stated otherwise, Services are offered on a cash-pay basis, and we and participating Providers and Pharmacies do not submit claims to insurance or government health programs. You authorize the disclosed charges, taxes, and shipping fees to your payment method.

If you select a recurring plan, you authorize recurring charges at the disclosed interval until you cancel. You may cancel future renewals through the patient portal or by contacting support before the next order begins processing. Cancellation does not reverse a clinical review or pharmacy order already in process. See the Refund Policy and Medication Return Policy.

8. Your account and information

You agree to provide accurate, current, and complete information and to update it when it changes. You are responsible for maintaining the confidentiality of account credentials and for activity under your account. Notify us promptly if you suspect unauthorized use. You may not create an account for another person or misrepresent identity, location, symptoms, or medical history.

9. Electronic communications

You consent to receive records, disclosures, notices, and service communications electronically. Standard email and text messaging may not be encrypted. By providing a telephone number, you authorize service-related calls or texts. Marketing consent is not a condition of purchase. Where you separately consent to marketing texts, message frequency varies and message and data rates may apply; reply STOP to opt out or HELP for help.

10. Permitted use and intellectual property

The Services and their text, graphics, designs, software, trademarks, and other content are owned by SYN Health, Inc. or its licensors and protected by law. Subject to these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable license to use the Services for lawful personal purposes. You may not copy, sell, reverse engineer, scrape, disrupt, or exploit the Services except as law expressly permits.

11. Prohibited conduct

You may not:

  • use the Services unlawfully, fraudulently, or to obtain medication for another person;
  • submit false, misleading, infringing, harmful, or malicious content;
  • attempt to bypass security, access restrictions, identity checks, or prescribing requirements;
  • interfere with the Services or another person's use of them; or
  • use automated tools to access or extract data without written permission.

12. Third-party services

The Services may integrate with or link to independent Providers, Pharmacies, payment processors, shipping carriers, patient portals, and other third parties. Their terms and privacy practices govern their services. We do not control third-party websites or services.

13. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE NON-CLINICAL SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE UNINTERRUPTED ACCESS, DELIVERY DATES, PRESCRIPTION APPROVAL, OR ANY PARTICULAR CLINICAL OR PERSONAL RESULT. RIGHTS THAT CANNOT LAWFULLY BE DISCLAIMED ARE NOT AFFECTED.

14. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SYN Health, Inc. AND ITS OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM THE NON-CLINICAL SERVICES. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED BY LAW OR A PROVIDER'S RESPONSIBILITY FOR PROFESSIONAL SERVICES.

15. Suspension and termination

We may suspend or terminate access when reasonably necessary to protect patients, comply with law, prevent fraud or misuse, or enforce these Terms. You may stop using the Services at any time, but outstanding payment obligations and terms intended to survive will remain in effect.

16. Changes

We may update these Terms by posting a revised version and an updated date. Material changes will receive additional notice when required. Continued use after the effective date means you accept the revised Terms.

17. General terms

Applicable federal law and the law of the jurisdiction governing the relevant transaction or dispute apply without regard to conflict-of-law principles. Before filing a non-clinical dispute, you agree to contact us and attempt to resolve it informally. If any provision is unenforceable, the remaining provisions remain effective. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a corporate transaction or by operation of law.
